Chủ đầu tư Dự án Xây dựng đường cao tốc Bến Lức – Long Thành đang đứng trước nguy cơ bị các nhà thầu kiện do không nhận được các khối lượng hoàn thành trong một thời gian dài.
Cầu dây văng Phước Khánh đã dừng thi công từ năm 2019
Áp lực thanh toán các khối lượng đã hoàn thành tại Dự án Xây dựng đường cao tốc Bến Lức – Long Thành đối với Bộ Giao thông – Vận tải (GTVT) và Tổng công ty Đầu tư phát triển đường cao tốc Việt Nam (VEC) là rất lớn, khi danh sách các nhà thầu quốc tế lên kế hoạch khởi kiện chủ dự án lên Trung tâm Trọng tài quốc tế ngày một dài thêm.
Theo thông tin từ Bộ GTVT – đơn vị chủ quản dự án, tình hình đặc biệt căng thẳng tại 2 gói thầu sử dụng nguồn vốn vay ODA từ Cơ quan Hợp tác quốc tế Nhật Bản (JICA). Do VEC không có vốn để thanh toán, nên từ giữa năm 2020 đến nay, các nhà thầu Nhật Bản đã yêu cầu VEC thanh toán khối lượng hoàn thành và chi phí phát sinh tính đến tháng 4/2021 khoảng 33 triệu USD.
Ngoài việc các nhà thầu đã thông báo đến Đại sứ quán Nhật Bản tại Hà Nội, JICA Việt Nam, các chi phí này tiếp tục tăng theo thời gian dừng thi công (khoảng 1 triệu USD/tháng).
Trong 2 gói thầu xây lắp sử dụng vốn vay JICA, vướng mắc lớn nhất tập trung vào Gói thầu J3 do nhà thầu đã có Thư yêu cầu chấm dứt hợp đồng và khởi kiện VEC ra Trung tâm Trọng tài quốc tế. Đây là gói thầu xây lắp có giá trị rất lớn, lên tới 3.558 tỷ đồng, do Liên danh Sumitomo Mitsui (Nhật Bản) – Công ty cổ phần Tập đoàn Cienco4 (Việt Nam) thi công, với hạng mục chính là cầu dây văng Phước Khánh.
Theo kế hoạch ban đầu, thời gian thực hiện Gói thầu J3 là 42 tháng, bắt đầu từ ngày 4/2/2016. Tuy nhiên, gói thầu này dừng thi công trên công trường từ tháng 9/2019 khi khối lượng hoàn thành đạt khoảng 80,70%; giải ngân đạt khoảng 85,80% giá trị hợp đồng; chưa thanh toán cho nhà thầu khoảng 48 tỷ đồng cho các khối lượng đã hoàn thành.
Ngày 26/3/2021, nhà thầu của Gói thầu J3 đã có văn bản yêu cầu chấm dứt hợp đồng do chưa được thanh toán cho các khối lượng đã hoàn thành; chưa có cam kết về thanh toán các chi phí do dừng chờ thi công (khoảng 250 tỷ đồng); chưa có kế hoạch bố trí vốn để tiếp tục thực hiện gói thầu; chưa có kế hoạch chính xác về việc triển khai lại gói thầu; hợp đồng đã kết thúc thời gian thực hiện, chưa được gia hạn…
Ông Nguyễn Duy Lâm, Thứ trưởng Bộ GTVT cho biết, cơ quan chủ quản đã có nhiều công văn chỉ đạo VEC, đồng thời có nhiều cuộc họp ba bên giữa JICA, VEC và nhà thầu để tìm ra biện pháp tháo gỡ. Tuy nhiên, đến nay, nhà thầu này vẫn giữ quan điểm sẽ chấm dứt hợp đồng.
Đối với các gói thầu xây lắp sử dụng vốn vay của Ngân hàng Phát triển châu Á (ADB), hiện 2 gói thầu A6 và A1 do các nhà thầu Hàn Quốc thi công cũng đã lên kế hoạch dừng thực hiện hợp đồng. Tại Gói thầu A1, nếu VEC không sớm tìm được nguồn thanh toán cho khối lượng đã hoàn thành trị giá 57 tỷ đồng, thì nguy cơ nhà thầu Halla Corporation tiến hành khởi kiện đòi bồi thường là rất lớn.
Giải pháp tạm khẩn cấp
Trong văn bản gửi Bộ GTVT, Ủy ban Quản lý vốn nhà nước tại doanh nghiệp vào cuối tháng 9/2021, VEC đề nghị một giải pháp xử lý tạm trong thời gian chờ Bộ Chính trị thông qua chủ trương chuyển đổi vốn vay về cho vay lại, bảo lãnh Chính phủ thành cấp phát ngân sách nhà nước đối với các dự án đang vướng mắc của VEC.
Cụ thể, VEC muốn được quyền tạm sử dụng nguồn thu phí, các khoản tiền nhàn rỗi chưa đến thời hạn trả nợ với số tiền khoảng 429 tỷ đồng để thanh toán ngay cho các nhà thầu Nhật Bản, nhằm tháo gỡ các khó khăn, vướng mắc về nguồn vốn cho Dự án Xây dựng đường cao tốc Bến Lức – Long Thành.
Đây là khoản tiền tối thiểu cần phải bố trí vốn để thanh toán ngay khối lượng đã hoàn thành của các nhà thầu Nhật Bản và tái khởi động thi công Dự án. VEC sẽ tiếp tục làm việc với các nhà thầu của Gói thầu J1 và J3, JICA để thảo luận, đàm phán theo hướng đề nghị nhà thầu J3 tiếp tục thực hiện công việc theo hợp đồng đã ký.
Theo phương án tài chính VEC đang trình cấp có thẩm quyền, lũy kế dòng tiền thu phí tại năm 2021 của VEC đang có khoảng 7.504 tỷ đồng (sau khi đã thanh toán hết các khoản nợ vay đến hạn) và lũy kế dòng tiền của VEC tại năm 2022 là 6.546 tỷ đồng. Trường hợp VEC tạm sử dụng nguồn tiền nhàn rỗi chưa đến thời hạn trả nợ với số tiền khoảng 429 tỷ đồng để tháo gỡ các khó khăn, vướng mắc về nguồn vốn cho Dự án Xây dựng đường cao tốc Bến Lức – Long Thành sẽ không ảnh hưởng đến khả năng trả nợ ngắn hạn của VEC.
“Số tiền này sẽ được thu hồi về tài khoản của VEC ngay sau khi Dự án được bố trí vốn ODA”, lãnh đạo VEC cam kết.
Theo đánh giá của Bộ GTVT, việc các gói thầu nêu trên không tiếp tục thực hiện sẽ ảnh hưởng rất lớn đến thời điểm hoàn thành của Dự án (được Thủ tướng gia hạn đến cuối năm 2023). “Nếu các vướng mắc về nguồn vốn không được sớm giải quyết trong ít tuần tới, có nguy cơ các nhà thầu còn lại của Dự án đồng loạt đề nghị chấm dứt hợp đồng và phát sinh khiếu kiện, khiếu nại đối với chủ đầu tư. Trong trường hợp này dự kiến thiệt hại về kinh tế là rất lớn, có thể đến hàng ngàn tỷ đồng”, lãnh đạo Bộ GTVT cho biết.
