Góp ý về đề xuất cơ chế đặc thù để triển khai xây dựng công trình hạ tầng kỹ thuật các tuyến đường xung quanh trung tâm thương mại Aeon Mall Hải Phòng, nhiều bộ ngành cho rằng đề xuất này chưa thuyết phục, chưa làm rõ được tính hiệu quả, tính cấp bách của dự án.
Theo báo cáo của UBND TP. Hải Phòng lên Chính phủ tại văn bản số 1166 ngày 7/3/2019, Trung tâm thương mại Aeon Mall Hải Phòng đã khởi công ngày 13/5/2018, dự kiến hoàn thành tháng 6/2020. Hải Phòng cam kết đầu tư xây dựng các tuyến đường giao thông đến chân hàng rào dự án, hoàn thành trước 1 năm trước khi Aeon Mall Hải Phòng đi vào hoạt động.
Theo đó, địa phương này đã thu xếp nguồn vốn đầu tư các tuyến được xung quanh Aeon Mall Hải Phòng theo hình thức BT, song nay chuyển sang đầu tư bằng nguồn vốn đầu tư công nên sẽ ảnh hưởng đến tiến độ đầu tư các tuyến đường này.
Để đảm bảo cam kết với nhà đầu tư, tránh ảnh hưởng tới môi trường đầu tư, Hải Phòng đề xuất Thủ tướng Chính phủ cho phép áp dụng cơ chế đặc thù xây dựng theo lệnh khẩn cấp, cấp bách để đầu tư hạ tầng kỹ thuật các tuyến đường xung quanh trung tâm thương mại Aeon Mall Hải Phòng (theo Nghị điịnh số 59 về quản lý đầu tư xây dựng).
Trong văn bản góp ý của mình, Bộ Giao thông Vận tải cho rằng báo cáo của Hải Phòng đề xuất Thủ tướng Chính phủ chưa làm rõ được tính hiệu quả, tính cấp bách của dự án cần áp dụng cơ chế đặc thù, tình hình giải phóng mặt bằng, công tác chuẩn bị đầu tư và huy động nguồn lực để thực hiện đầu tư hạ tầng kỹ thuật các tuyến đường xung quanh Aeon Mall Hải Phòng để đủ điều kiện áp dụng theo công trình khẩn cấp, cấp bách.
Theo Bộ Kế hoạch và Đầu tư, đề xuất áp dụng cơ chế đặc thù theo lệnh khẩn cấp với dự án xây dựng công trình hạ tầng kỹ thuật các tuyến đường xung quanh trung tâm thương mại Aeon Mall nhằm tháo gỡ những khó khăn, tạo điều kiện cho việc đẩy nhanh tiến độ, đảm bảo thực hiện đúng cam kết với nhà đầu tư nước ngoài, tuy nhiên, qua nội dung giải trình, Bộ nhận thấy với tính chất của dự án này không thuộc điều kiện để áp dụng đối với công trình xây dựng theo lệnh khẩn cấp, cấp bách.
Bộ Kế hoạch và Đầu tư trong văn bản góp ý còn dẫn giải, việc áp dụng lệnh khẩn cấp, cấp bách (Khoản 2 Điều 42 Nghị định 59) Hải Phòng đưa ra lý do dự án trước đây được áp dụng hình thức hợp đồng BT nhưng căn cứ ý kiến của Bộ Tài chính tại công văn 3515 về xử lý một số vấn đề chuyển tiếp trong quản lý, sử dụng tài sản công, thì UBND Tp.Hải Phòng đã tạm dừng việc quyết định sử dụng giá trị quyền sử dụng đất thanh toán cho nhà đầu tư theo hình thức hợp đồng BT đối với dự án.
Đồng thời nếu chuyển hình thức đầu tư bằng nguồn vốn đầu tư công trung hạn sẽ không đảm bảo thời gian xây dựng công trình điều này gây trở ngại cho Hải Phòng trong việc thực hiện đúng cam kết với nhà đầu tư.
Cũng theo Bộ Kế hoạch và Đầu tư, dự án đầu tư xây dựng theo hình thức BT, Nghị quyết 160 về việc sử dụng tài sản công để thanh toán cho nhà đầu tư thực hiện dự án theo BT, đã có hướng dẫn rõ ràng, cụ thể, theo đó Hải Phòng cần xem xét, áp dụng với dự án cho phù hợp. Ngoài ra, theo bộ này, do đây là cam kết của Hải Phòng với nhà đầu tư nước ngoài nên có trách nhiệm chủ động huy động, cân đối nguồn lực hợp pháp để hoàn thành dự án đúng tiến độ.
Và do vậy, Bộ Kế hoạch và Đầu tư cho rằng, đề xuất của Hải Phòng là chưa thực sự thuyết phục.
Bộ Xây dựng trong góp ý cũng cho rằng căn cứ vào quy mô dự án cũng như việc chưa xác định được nguồn vốn cho dự án thì kiến nghị được áp dụng quy định theo lệnh khẩn cấp, cấp bách trên của Hải Phòng là chưa đủ cơ sở.
