  1. Tại sao cần phải xin giấy phép quảng cáo mỹ phẩm? 

Theo quy định tại Điều 1, Điều 2 của Thông tư 09/2015/TT-BYT  khi mỹ phẩm muốn quảng cáo cần phải làm thủ tục xin giấy phép quảng cáo mỹ phẩm.

Theo quy định tại Điều 67 quy định mức phạt hành chính đối với hành vi vi phạm các quy định về xác nhận nội dung quảng cáo đối với các sản phẩm, hàng hóa, dịch vụ đặc biệt:

  • Phạt tiền từ 5.000.000 đồng đến 10.000.000 đồng đối với hành vi quảng cáo các sản phẩm, hàng hóa, dịch vụ đặc biệt mà không được cơ quan nhà nước có thẩm quyền xác nhận nội dung trước khi thực hiện quảng cáo theo quy định.
  • Biện pháp khắc phục hậu quả: Buộc tháo gỡ, tháo dỡ hoặc xóa quảng cáo đối với hành vi quy định tại Khoản 1 Điều này.

Việc xin giấy phép quảng cáo mỹ phẩm không những giúp doanh nghiệp tránh khỏi những rắc rối pháp lý mà còn giúp doanh nghiệp tạo ra những quảng cáo “chính hiệu”, “độc quyền” của riêng mình , tránh những tình trạng trùng lẫn hay ăn cắp ý tưởng.

Hơn nữa, với tốc độ truyền tải thông tin cực kỳ nhanh chóng trong thời đại kỷ nguyên số hiện nay, việc xác nhận thông tin truyền tải trước khi đến công chúng là điều cực kỳ quan trọng, tránh những nội dung phản cảm, không hợp thuần phong mỹ tục, phản khoa học….được phát tán tràn lan trên các cổng thông tin đại chúng, giúp người tiêu dùng tiếp cận thông tin có nguồn gốc rõ ràng, đảm bảo chính xác về nội dung.

  1. Việc xin giấy phép quảng cáo mỹ phẩm dựa vào cơ sở pháp lý và cơ quan nào cấp phép?

Việc xin giấy phép quảng cáo mỹ phẩm dựa vào:

– Luật 16/2021/OH13

– Nghị định 181/2013/NĐ-CP

– Thông tư 09/2015/TT-BYT

– Thông tư 03/2013/TT-BTC

Với sự xác nhận của các cơ quan:

  • Sở Y tế
  • Phương tiện quảng cáo: báo nói, báo hình, tờ rơi, truyền hình,truyền thanh, hội thảo, hội nghị, tổ chức sự kiện
  1. Những lưu ý khi thiết kế nội dung xin giấy phép quảng cáo mỹ phẩm?

Khách hàng khi tiến hành thiết kế nội dung quảng cáo mỹ phẩm cần lưu ý phải phù hợp với các tài liệu sau đây:

  • Phiếu công bố sản phẩm mỹ phẩm theo quy định của pháp luật về dược
  • Tài liệu chứng minh tính an toàn, hiệu quả của mỹ phẩm và tuân thủ theo hướng dẫn về công bố tính năng sản phẩm mỹ phẩm của hiệp hội quốc tế (nếu có).
  • Quảng cáo mỹ phẩm phải có các nội dung sau đây:

+ Tên mỹ phẩm

+ Tính năng, công dụng của mỹ phẩm

+ Tên, địa chỉ của tổ chức, cá nhân chịu trách nhiệm đưa sản phẩm ra thị trường

+ Các cảnh báo theo quy định của các hiệp định quốc tế

  • Nếu nội dung quảng cáo không có trong phiếu công bố mỹ phẩm thì cần cung cấp thêm Tài liệu chứng minh cho tính năng, công dụng của sản phẩm.
  • Không được quảng cáo mỹ phẩm gây hiểu nhầm sản phẩm đó là thuốc. 
  1. Hồ sơ xin giấy phép quảng cáo mỹ phẩm gồm những gì?
  • Nội dung quảng cáo
  • Mẫu nhãn sản phẩm
  • Các tài liệu tham khảo, chứng minh liên quan đến nội dung quảng cáo (nếu có)
  • Phiếu công bố
  • Giấy phép kinh doanh của đơn vị xin quảng cáo

Lưu ý:

+ Các tài liệu bằng tiếng Anh phải dịch ra tiếng Việt và kèm theo giấy tờ bản gốc để đối chiếu . Bản dịch tiếng Việt phải được đóng dấu xác nhận của đơn vị đề nghị xác nhận nội dung quảng cáo;

+ Các tài liệu bằng tiếng nước ngoài không phải là tiếng Anh phải dịch ra tiếng Việt và kèm theo tài liệu gốc bằng tiếng nước ngoài. Bản dịch tiếng Việt phải được công chứng theo quy định của pháp luật.

+ Các giấy tờ trong hồ sơ phải còn hiệu lực, là bản sao chứng thực hoặc bản sao có đóng dấu của đơn vị đề nghị xác nhận nội dung quảng cáo. Các tài liệu trong hồ sơ phải có dấu, dấu giáp lai của đơn vị đề nghị xác nhận nội dung quảng cáo.

+ Mẫu nội dung quảng cáo được trình bày trên khổ giấy A4. Mẫu hình thức quảng cáo ngoài trời khổ lớn có thể trình bày trên khổ giấy A3 hoặc khổ giấy khác và ghi rõ tỷ lệ kích thước so với kích thước thật.

  1. Hiệu lực của giấy phép quảng cáo mỹ phẩm là bao lâu?

Tuỳ vào hồ sơ sẽ có hiệu lực khác nhau, hiệu lực của giấy phép quảng cáo mỹ phẩm căn cứ dựa trên hiệu lực của phiếu công bố mỹ phẩm của sản phẩm đó. Theo quy định tại khoản 2 Điều 23 Thông tư 09/2015/TT-BYT thì giấy phép quảng cáo sẽ hết hiệu lực trong các trường hợp sau:

+ Phiếu tiếp tiếp nhận công bố mỹ phẩm đã hết giá trị.

+ Mỹ phẩm bị cơ quan quản lý nhà nước có thẩm quyền khuyến cáo ngừng sử dụng hoặc bị thu hồi sản phẩm.

+ Có những thay đổi về thông tin ảnh hưởng đến tính an toàn và chất lượng của mỹ phẩm.

  1. Đối với sản phẩm mỹ phẩm nhập khẩu từ nước ngoài được Cục quản lý dược cấp phép thì xin giấy phép quảng cáo ở đâu?

Đối với sản phẩm quảng cáo mỹ phẩm sản xuất trong nước do Sở Y tế hoặc  mỹ phẩm do Cục quản  lý Dược cấp đều do Sở Y tế cấp phép quy định cụ thể như sau:

” Sở Y tế tỉnh, thành phố trực thuộc Trung ương cấp giấy xác nhận nội dung quảng cáo đối với  Mỹ phẩm của cơ sở đứng tên trên phiếu công bố sản phẩm mỹ phẩm có trụ sở chính đặt tại địa bàn quản lý của Sở Y tế” .

Nên dù sản phẩm mỹ phẩm của bên bạn có nhập khẩu từ nước ngoài về do Cục quản lý Dược cấp phiếu công bố mỹ phẩm thì thẩm quyền xin giấy phép quảng cáo mỹ phẩm vẫn do Sở Y tế cấp giấy phép quảng cáo mỹ phẩm.

  1. Thời gian xin giấy phép quảng cáo mỹ phẩm thường là bao lâu?

Thời gian thông thường sẽ từ 15 – 20 ngày kể từ ngày nộp hồ sơ hợp lệ.
