Cụ thể, theo phản ánh của các doanh nghiệp thủy sả, tại Dự thảo ngành thủy sản bị xếp vào mức 3 của “Loại hình sản xuất, kinh doanh, dịch vụ có nguy cơ gây ô nhiểm môi trường” của Phụ lục 5 “Danh mục loại hình sản xuất, kinh doanh, dịch vụ có nguy cơ gây ô nhiễm môi trường” có lưu lượng xả nước thải ra môi trường chỉ từ 200 m3/ngày trở lên thì phải lắp hệ thống quan trắc tự động nước thải. Như vậy, quy định này đã giảm 5 lần, từ mức 1.000 m3/ngày hiện nay xuống 200 m3/ngày. Yêu cầu này sẽ khiến gần như 100% các nhà máy phải đầu tư hệ thống quan trắc với hàng tỉ đồng/hệ thống, thêm chi phí vận hành từ 40 – 50 triệu đồng/kỳ quan trắc.
Hay Dự thảo còn đưa ra ngưỡng lưu lượng xả thải từ 15.000 m3/ngày trở lên thì “tần suất quan trắc nước thải định kỳ” là 1 tháng/lần trong khi quy định hiện hành chỉ là 3 tháng/lần sẽ làm tăng chi phí lấy mẫu và phân tích mẫu lên rất nhiều.
Hơn nữa, việc đưa ngành chế biến thủy sản vào mức 3 của “Loại hình sản xuất, kinh doanh, dịch vụ có nguy cơ gây ô nhiễm môi trường” là không công bằng bởi thực tế so với các ngành công nghiệp chế biến thực phẩm nói chung thì nước thải của ngành thủy sản ít ô nhiễm môi trường, ít độc hại hơn nhiều nhưng lại bị xếp vào mức độ cao hơn. Theo QCVN 11:2015 về nước thải nhà máy chế biến thủy sản, nước thải chế biến thủy sản là không có các chỉ tiêu nước thải độc hại; các chỉ tiêu nước thải cũng chủ yếu có nguồn gốc từ cơ thịt thủy sản và các phụ gia thực phẩm, đều là những chất từ tự nhiên và ăn được đối với con người, không gây độc hại mạnh như những hóa chất dùng trong các ngành công nghiệp khác…
Nhiều doanh nghiệp thuộc Hiệp hội Giấy và Bột giấy Việt Nam, Hiệp hội Nhựa Việt Nam (VPA), Hiệp hội Dệt may Việt Nam (VITAS), Hiệp hội Doanh nghiệp điện tử Việt Nam… cũng cho rằng thủ tục cấp giấy phép môi trường phức tạp, trùng lắp; một số điều kiện bất hợp lý trái với các nghị quyết của Chính phủ. Chẳng hạn, trước đây, chỉ có các dự án gây ô nhiễm đến môi trường (nhóm I) mới phải làm báo cáo đánh giá tác động môi trường (ĐTM) và xin cấp giấy phép môi trường (GPMT).
Nhưng theo Dự thảo thì các dự án và nhà máy nhóm I và nhóm II kể cả đã hoạt động cũng phải làm ĐTM và xin cấp GPMT. Điều này làm gia tăng thủ tục hành chính nhưng lại không có hiệu quả, cụ thể. Quy trình cấp phép không hiệu quả để bảo vệ môi trường do chỉ là tiền kiểm thì không thể phát hiện được các vi phạm, mà bài học đau đớn là trường hợp Forrmosa… Đồng thời, có nhiều quy định bất hợp lý chưa phù hợp với thực tiễn, gây khó khăn cho doanh nghiệp như phí tái chế sản phẩm, bao bì (EPR) do cách tính, thu và quản lý phí có nhiều điểm bất hợp lý và thiếu minh bạch…
